A reputable Litigation and Conveyancing law firm located in Durban.

Job Description

Our client is seeking a strong Litigator with approximately 7 years of post-admission experience, ideally gained in Commercial Litigation and /or General/ Civil Litigation and is currently in practice. The firm represents several corporates and handles a wide range of commercial and general litigation matters.

You will be responsible for:

Commercial law:

Mergers and acquisitions
Advice and opinions pertaining to commercial transactions
Structuring of commercial transactions and corporate structures
Drafting of all types of commercial transaction documents
Due diligence investigations and reports

Corporate Law and Administration:

Drafting of shareholders’ agreements, association agreements and partnership agreements
Drafting of memoranda of incorporation
Preparation of board, shareholder, trustee and partner resolutions, notices, agendas and minutes
Preparation and administration of share registers, share certificates and share transfer forms
Preparation and lodgement of company secretarial documents for registration by the Companies and Intellectual Property Commission
Creation and maintenance of trust records in a secure electronic repository
Advice regarding corporate law as applied to commerce and the interpretation of legislation
Attending to closing requirements in respect of commercial and corporate transactions

Insolvency:

Voluntary and compulsory sequestration applications
Voluntary and compulsory winding-up applications
Deregistration of companies and close corporations
Business turnaround and reconstruction, including schemes of arrangement

Public Liability;

Defending public liability claims and litigation
Advice and opinions relating to public liability issues
Advice on and drafting of indemnity provisions and signage

Dispute Resolution and Litigation;

Instituting and defending legal proceedings
Conciliation, mediation and arbitration proceedings
Advice and opinions relating to disputes

Qualifications

An admitted attorney of the High Court of South Africa with at least 7 years post-admission experience or post articles experience.

Skills

The successful candidate must have:

Extensive experience in commercial litigation and general litigation (with preference given to candidates who have experience in commercial litigation matters)
Extremely good work ethic and ability to engage with premium clients
Independent and be able to manage own litigation practice with approximately 80 or more matters
Be well-versed in various Microsoft platforms
Be able to work in a team and report to partners
Preference will be given to candidates who are able to bring clients and/or their own matters to the firm
Preference will be given to candidates residing within the greater Durban area. In the event that a suitable candidate is located outside the greater Durban area and is required to relocate, the candidate is responsible for relocation costs.
