SUMMARY:
Manager - Regulation Development

POSITION INFO:

Job Purpose

Assist Technical Divisions in developing legally sound and concise regulations and technical standards. Manage and spearhead the formulation and approval of regulations and technical standards through a consultative process with the aviation industry in terms of section 157 of the Civil Aviation Act, 2009 (Act No. 13 of 2009). Manage Secretarial support of the Regulations Committee. Provide regulatory and general legal support services; Ensure that Company is protected against any legal risk by providing legal, regulatory and technical support services. Drafting or vetting proposals for amendment of regulations and technical standards; drafting legal opinions, vetting and drafting of contracts, advising on any legal matter; drafting and vetting of legal and non-legal documentation, provide legal support services in meetings when requested to do so by company’s Divisions. Draft Board and Executive Committee submissions

Key Performance Areas

Regulation Development and provision of legal support services

  • Draft/vet proposals for amendment of regulations and technical standards
  • Facilitate and monitor the approval process of the regulations and adhere to deadlines 
  • Draft Board and Executive Committee submissions, draft monthly reports, analyse exemptions and provide legal advice thereto
  • Perform any other function for Legal and Aviation Compliance Department when delegated to do so by the Senior Manager: Legal and Aviation Compliance and the Chairperson of Regulatory Committee
  • Provide any legal advice when assigned to do so
  • Manage and oversee Regulations Committee secretarial functions
  • Draft and vet all regulatory amendments and ensure that they meet regulation drafting principles before submission to proper authorities 
  • Adhere to submission turnaround times

Drafting of Legal Opinions

  • Research and draft accurate and legally correct legal opinions

Litigation Process

  • Consider the merits of the matter 
  • Research the legalities pertaining to the matter and ensure that company is protected against any legal risk that may arise
  • Coordinate, provide assistance to, monitor and guide the attorneys in the litigation matters

Drafting of Contracts

  • Draft, vet, interpret and advise on contracts to ensure compliance and protect the interests of the company

Management

  • Guide and mentor Legal Advisors and Regulation Development Administrator
  • Manage and monitor the performance of Legal Advisors and Regulation
  • Development Administrator. Constantly train Legal Advisors and Regulation Administrator
  • Manage all activities of Regulation Committee and report to the Chairperson of various committees accordingly

Minimum Requirements

  • B Proc or LLB, admitted as an Attorney or Advocate (successfully completed pupilage with a recognized association) and a Certificate in Legislative Drafting
  • Minimum of Minimum of 5 years’ experience as an Attorney or Advocate with relevant exposure to among others interpretation of statutes, Admin Law and Commercial Law in General
  • Minimum of 5 years post Admission Experience
