POSITION INFO:

Superintendent, Contracts Management role to be based in DRC 

 

The Superintendent, Contracts is responsible to plan, organize and control the activities of the Contracts Team in order to approve and manage commercial aspects of all contracted activities in accordance with existing Company standards, policies and procedures and the DRC law. In cases where standards and policies do not exist, the Superintendent, Contractsis responsible to develop such policies and procedures. 

 

In addition, ensuring a high level of support service to internal departments for contract and tender document drafting, tender reviews, negotiating, preparation, administration and management and applying an ethical, efficient, risk managed, consistent and cost-effective approach at every stage of the process.

 

Qualification:

  • A degree or diploma in contracts/commercial law would be preferred.
  • Admitted Attorney would be advantageous
  • 5 years’ experience in Contract Administration/Management capacity in the building, construction or mining sectors
  • To be fully versed and competent in FIDIC and NEC construction contracts.

 

Responsibilities:

  • Develop, establish, implement and maintain contracting policy, procedures and systems, and monitor the adherence of these procedures within the Company and its Contractors. 
  • Establish and develop the Contracts Team with sufficient trained staff to carry out the tasks of oversight of the EPCM process and carry out operational readiness tasks. 
  • Ensure successful procurement of services and certain goods through effective contracting in terms of costs, quality, quantity, services and availability
  • Select, train and develop personnel to form an effective team and monitor individual staff development plans in line with the Company succession planning. 
  • Develop contract plans and strategies based on Company contracting requirements and provide regular progress status reports of all contracting activities. 
  • Develop, implement and update the database and systems requirements for Company finance, contract management, electronic-business and related systems. 
  • Manage contract and contractor administrative matters relating to claims, disputes, invoicing/payments, correspondence, review meetings, back charges, taxes, insurance, liability, indemnities, bonds and retentions, variations, contractor communication, and DRC Government regulations. 
  • Develop and maintain standard contract documents and train staff to prepare formal contract documentation customized to suit specific contract requirements of the Company’s operational and construction activities.
  • Provide specific focus and compliance to contract management and contractor activities with respect to Company standards for health safety and loss control, environmental management, external relations and local business initiatives and support. 
  • Ensure approval all requests for contracts and execution of all contracts are carried out in accordance with Company policies and procedures. 
  • Responsible for managing critical contractual formation, obligations, risk and liability. 
  • Add to the project bottom line by strategic thinking and action to reduce effort and increase revenue by timely intervention. 
  • Provide support in the development of Company policies and procedures.
  • Provide discipline reports on a monthly and weekly basis. 
  • Provide mentoring to national staff. 

 

Key Competencies:

  • Drafting of contract documents and agreements
  • Monthly administration of all contracts, including claims, variations, disputes, and contractor communication
  • Development of contracts management systems, policies, and procedures, including the development of staff members in the Contracts Team
  • Project and Company risk management in terms of contracting functions
  • Adhoc contractual, policies, and procedural support to various Company departments
