POSITION INFO:

Vacancy: Compliance Manager

The main responsibility of this role is to take full responsibility for the companies’ compliance management function.

Key responsibilities

1. Strategy

Developing a compliance strategy.

Taking ownership of key responsibilities and implement the companies’ overall compliance management function and strategy in consultation with the key stakeholders.

Developing and proposing new policies, procedures and guidelines to give effect to this strategy.

Reviewing and continuously improving the strategy, processes, policies, procedures, guidelines and activities.

2. Consultation

Working closely with management and employees to ensure and monitor the continued implementation of the companies’ compliance standards, rules and policies, and streamlining the processes of compliance in consultation with these stakeholders.

Provide a day-to-day regulatory advice.

3. Identification and mitigation of new risks

Working proactively to remain abreast of amended or new legislation so as to quickly identify new compliance obligations specific to the company environment and strive towards best practice in managing compliance issues.

4. Policy creation

Taking a leading role in coordinating internal stakeholders to develop new policies, procedures and guidelines to address identified compliance issues, and facilitating the drafting, review, approval and implementation of such policies, procedures and guidelines.

Ensuring that all business practices, processes, & activities are consistent with appropriate regulatory & statutory obligations.

Ensuring such policies and the like are submitted with relevant Governmental authorities or institutions.

5. Policy/Procedure management

Ensuring policies, procedures, guidelines and associated materials are regularly updated.

Ensuring that all policies, procedures, guidelines and associated materials are both easily accessible to employees and stored in the company document management system.

Being responsible for the oversight of Regulatory change management within the business and provide guidance on compliance in the various business areas.

Managing documentation, templates, frameworks and records as part of the company document management system.

6. Communication

Ensuring effective communication of the policies and procedures to employees, and the development/refinement of forms, checklists and procedures.

Updating the business on compliance and risk management issues.

Ensuring timeous communication to and with relevant external stakeholders, including

Governmental authorities, if and when the need arises.

Processing, co-ordinating and responding to all requests for information and, where applicable, notification of requests for information, potential complaints or breaches to the Information Regulator’s Office (PAIA and POPIA), or liaising with MIOSA on consumer related matters.

7. Reporting

Preparing reports on a regular basis for the Management Team.

Updating the Executive Committee on progress made, where requested.

Escalate breaches of policies and procedures appropriately.

8. Third parties/Value Added Resellers/Service Providers

Conducting compliance due diligences in respect of company value added resellers, fitment centres, call centres and service providers and evaluating their compliance with PSIRA, the CPA and POPIA (incl. security measures in respect of POPIA), where relevant.

9. Training

Developing and delivering of comprehensive awareness training programmes including face-to-face and online training.

Promoting compliance awareness throughout the business by providing training and written procedures that are widely disseminated and made available to all employees.

Ensuring that stakeholders are sufficiently tested on their compliance knowledge after training has taken place.

10. Administration

Registering IO and DIO’s with the Information Regulator, employees with PSIRA, etc.

Conducting internal audits & reviews at regular intervals to ensure that compliance procedures are followed within the business.

Maintaining a log of any incidents and remedial recommendations and actions.

Defining, updating and maintaining the retention schedule and physical items inventory log, archiving processes, providing advice and guidance to the business, and ensuring that all records, lists, tables and the like regarding compliance related matters are managed appropriately.

Ensuring the creation, drafting and implementation of the contracts register as part of a central document management system.

Ensuring compliance with all legislative requirements generally.

Qualifications and Experience:

Qualifications: A legal, risk, compliance or other relevant tertiary qualification. A postgraduate qualification in the field of law and/or compliance management, specialising in data protection and security, will be advantageous.

Experience: At least 5 years’ appropriate experience within a corporate or professional services environment as a compliance manager. Compliance Institute of South Africa (CISA) certification will be preferred.
