JOB SUMMARY:
Our client based in Durban is looking for the Contracts Manager: Legal to  manage and ensure all contracts and procurement processes are legally sound and protects the Company’s interest

JOB DESCRIPTION:

Key Performance Areas
  • Draft and expedite the signing off:
  • a. Commercial contracts, Service Level
  • Agreements and Addendums
  • b. Contract amendments and extensions
  • c. Legal notices to Suppliers
  • Negotiate contractual terms and conditions with the Service Provider.
  • Vetting of Commercial contracts and Service Level
  • Agreements.
  • Identifying and managing contractual risk management issues.
  • Reviewing and updating DTPC’s contractual terms and conditions to ensure:
  • a. it complies to all applicable laws and legislations
  • b. legally binding
  • Identify innovative ways to improve the current contract drafting. methodology and style.
Provide legal services and support
  • Review and provide inputs to Procurement documentation to ensure alignment to the contracting process.
  • Participate in negotiations regarding the drafting of contracts, service level agreements and addendums.
  • Identify potential risks and advise on ways to mitigate the risks.
  • Review the extensions and terminations of contracts and other procurement related agreements to ensure compliance with legislation.
  • Responding to any legal queries arising from the delivery of goods and/or services and any other contract related issues.
  • Identify any contractual discrepancy or disputes and facilitate resolution thereof.
  • Support Project Managers in interpreting the general terms and conditions of contracts, including the application of such conditions.
  • Provide input for the effective structuring of contracts and business deals.
  • Liaise with Manager: Legal Services on all matters identified for external legal opinion.
  • Provide legal input into DTPC Supply Chain Management and Contracts Management policies and procedures in line with relevant laws and regulations.
  • Provide guidance on contract matters to project managers or other operational staff, including training in contracting practices and procedures.
  • Develop and implement procedures for contract management and administration in compliance with company policy. As appropriate, contribute to or influence company policies and make recommendations to company policies where applicable.
  • Conduct compliance audits on identified contracts.
  • Review and advise draft guarantees supplied by the service providers and tenants.
Qualifications, Knowledge
  • LLB or Higher Diploma in Commercial Law or equivalent
  • Knowledge of the PFMA and Treasury Regulations
  • 5 to 9 years’ experience in Contracts or Commercial Law
  • Being a team player who is able to build relationships and value diversity in business
  • Ability to network at all levels
  • Excellent communication skills, both oral and written
  • Integrity and discipline
  • Good organising and planning skills
  • High level of attention to detail and accuracy
