Legal Counsel

SUMMARY:
To provide legal advisory services and support to the business by providing effective and efficient 1st line of defence business assurance support.

POSITION INFO:

The Legal Counsel will provide legal advisory services and support to the business by providing effective and efficient 1st line of defence and business assurance support. The function will report to the Head of Legal to support and enable the business to ensure that regulatory and other legal risks are effectively managed, ensuring business sustainability and growth.

Description

The Legal Counsel will be:

• Providing in-house legal support across all relevant areas, with a focus on dealing with various agreements, binding authority agreements and insurance policy interpretation, if required
• Providing appropriate legal advice, legal interpretation and legal opinions
• Identifying, advising on and evaluating legal risk
• Supporting and enabling the business to develop policies and procedures to effectively manage the legal risks identified
• Providing pro-active support and innovation in the structuring of all partnerships to ensure compliance with legislation
• Reviewing and signing off policy wordings and other related documents as requested by the business
• Managing claims litigation processes by briefing and appointing attorneys in litigation matters and facilitating the defending or settling of litigation matters
• Assisting and providing support with the legal due diligence process by identifying legal risks and enabling the business to implement the appropriate controls to mitigate these risks
• Conducting strategic reporting on business relevant issues with the purpose of identifying trends in order to mitigate and prevent future risks
• Researching and analysing the implications of case law, legislation and regulatory matters
• Providing all stakeholders with regular information regarding new legislation (including new Bills, Acts, Regulations, Standards, Directives and Case Law) through training, creating awareness, drafting practice notes and updating the business on upcoming changes to existing legislation
• Interpreting all new legislation and regulation and preparing high level impact analyses
• Managing outsourcing legal services in terms of engagement with external Attorneys and managing legal costs
• Reviewing and negotiating BAU documentation, including NDAs, powers of attorney, side letters, contract and policy novation, transfers, assignment agreements etc.
• Developing strong working relationships, and collaborating with, key stakeholders, including the wider business, Company Secretariat and Compliance.

Profile

The Legal Counsel should have the following qualificaions and experience:

• Recognized legal qualifications from within South Africa jurisdiction
• Minimum 4 - 5 years of post-qualification experience in a law firm or in-house legal role with strong legal experience in general insurance or financial services.
• Experience in relevant legislation and regulations
• Experience in drafting, reviewing and negotiating related agreements
• Experience in implementing new regulation in large groups
• Experience in working with management teams and functional heads
• Experience in managing external lawyers especially in relation to commercial matters
• Experience of dealing with regulators and industry bodies
• Experience in negotiating outsourcing and procurement agreements
• Ability to analyze complex legal problems quickly and concisely without direct supervision
• Ability to exercise good judgment even in ambiguous situations

CTC on offer in the region of R710K excl. STI

Salary may be negotiable depending on current market levels and their preferred candidate''s level of experience.
